Lawsuit filed: Houston cashier for Sicily Pizza and Pasta sues for unpaid overtime

On March 12, 2014, attorneys for Dunham & Jones, P.C. filed their Amended Complaint on behalf of their client Anthony Vargas. The lawsuit is filed in United States District Court for the Southern District of Texas, Houston Division. The suit alleges that Defendants Equa-Advance, Inc., Luis Andrade, and Andrea Andrade employed Mr. Vargas as a cashier in their restaurant, Sicily Pizza and Pasta. The suit also alleges that Mr. Vargas was made to work overtime and was paid only straight time for his overtime hours. This violates the Fair Labor Standards Act which generally requires employers to pay employees time and one-half for all hours worked over 40 in a workweek.

Lawsuit filed: Former Dallas restaurant worker at PhoXpress Restaurant sues for unpaid overtime

Restaurant worker Bryant Ho has sued his former employer, XPRESS PHO, LLC, for violations of federal wage and hour laws. The lawsuit alleges than Mr. Ho worked at PhoXpress Restaurant and worked over forty hours during many workweeks without being paid proper overtime. Rather than being paid time and one-half for his overtime hours, Mr. Ho was paid straight time. The suit, filed in Dallas Federal Court on February 12, 2014, seeks compensation for unpaid overtime, a penalty in the form of liquidated damages, attorney’s fees, and court costs.

Lawsuit filed: Former Dallas Super 8 Motel workers sue MDS Enterprises, Inc. for minimum wage and overtime violations

On February 11, 2014, the overtime lawyers at Dunham & Jones, P.C. filed suit in Federal Court in the Northern District of Texas, Dallas Division against MDS Enterprises, Inc. and Sunil Shah on behalf of former employees Randall Burch and Casey Collett, alleging both minimum wage and overtime violations.

Mr. Burch, whose primary duty was as an overnight auditor, and Ms. Collett, whose primary duty was as a front desk clerk, filed suit under the Fair Labor Standards Act (“FLSA”) alleging that they frequently worked more than 40 hours per week, but were never paid time and one half for these hours. Burch and Collett worked for Defendants at their Super 8 Motel.
